Ohio House passes bill aiding human trafficking victims with criminal record expungement

The Ohio House, with the support of State Representative Tracy Richardson (R-Marysville), passed legislation on Wednesday aimed at expunging certain non-violent crimes for victims of human trafficking.

Senate Bill 214, which complements Richardson’s House Bill 385, received unanimous support in committee. The legislation seeks to expand the ability of human trafficking victims to expunge misdemeanors and fourth- and fifth-degree felonies committed while they were under duress from traffickers.

“This bill offers hope by expanding expungement opportunities for the victims and survivors of human trafficking,” said Richardson. “They have suffered the atrocity of being forced to perform crimes against their will. This legislation establishes a pathway out of enslavement for certain victims and will give them an opportunity to reintegrate into society.”

To qualify for expungement under this legislation, individuals must provide clear and convincing evidence that their participation in the offense was due to being a victim of human trafficking.

The bill now proceeds to the Governor's office for further consideration.
