Ohio establishes state UAV laws with House Bill 77

Ohio is set to implement local laws for unmanned aerial vehicles (UAVs) following the signing of legislation by the Governor. State Representative Bernie Willis (R-Springfield) spearheaded the bill, which aligns state regulations with federal standards established by the Federal Aviation Administration.

The new law, codified in House Bill 77, introduces four prohibited flying operations within Ohio's jurisdiction. These include operating drones recklessly or in ways that endanger others, using drones in violation of FAA regulations, interfering with first responder activities, and recording or loitering near critical infrastructure without permission.

Willis emphasized that this legislation does not introduce new licensure requirements for UAV pilots but rather empowers Ohio to manage its airspace more effectively. "Ohio will now have the ability to prosecute their own UAV laws that mirror federal law," Willis stated. He added that the law allows for holding unsafe operators accountable locally without relying on federal prosecution.

Additionally, the legislation grants local governments authority to impose further restrictions on recreational drone operations over parks and public properties they own. The Ohio Department of Transportation Office of Aviation will be responsible for publishing all drone-related regulations within the state.

House Bill 77 is scheduled to take effect in 90 days.
